Legal Conference on property was organised at World Trade Centre, Dubai by M/s Sumansa Exhibitions in their Indian Property Show. Mr. A. R. Gupta was specially invited to address the audience on such subject as taxation on sale and purchase on property, property transaction and documentations. Mr. A. R. Gupta accompanied by Advocate Mr. Aditya Gupta conducted the seminars on 1st December 2015 and 3rd December 2015. The said seminars got overwhelming response from NRIs and PIOs residing in Dubai and across the globe.

The real estate sector in India is one of the fastest growing markets in the world. The real estate boom in India is interlinked with industrial and economic growth. India has become preferred destination for investment in real estate sector due to stability and strong presence of multinational companies throughout the country. Real estate sector is a huge growth driver and has absorbed second largest employment in the country after agriculture. On the other side there are many challenges faced by the Industry and the legal and regulatory environment needs to be improved in the sector. To meet the regulatory challenges there needs to be better involvement and understanding of the regulations. This symposium is making an attempt to make the participants understand various facets of real estate laws particularly nature of transactions, documentations, due diligence and latest provisions relating to taxation which is more targeted towards curving black money and anti-social money which was hither to prevalent in this industry. The topics covered in the symposium will elaborately deal with some of the most important aspects of real estate. To start with it is very important that the participants must know about various provisions of law as well as terminology used legally for different property transactions such as sale of property always means that the property has passed hands from the seller to the purchaser though in case of agreement to sell it is not so. Similarly, no title passes in equitable mortgage while in some of other kind of mortgages, title may also pass on to the mortgagee. Property can also be transferred by way of gift, relinquishment, inheritance and succession. Similarly it is very important to understand what do we mean by clear and marketable title. The person who is purchasing the property and putting his life time savings in the property must ensure that he is getting clear and marketable title because no one can give you better title than the one has. Lack of knowledge can make the investor lose his valuable investment and face unending litigation.

The objectives of the summit can be briefly summed up as- To explain legal terminology of property transactions. To explain documentations used in property transactions. To make participants aware of changing trends in property transactions. Investment opportunities. To secure one’s investment in the property. This symposium of very limited duration will still help the participants to understand the nitty-gritty of real estate industry from legal prospective.

Mr. A.R. Gupta & other members of the team addressed a seminar organized by a leading bank at Mt. Abu, Rajasthan in the year 2010. The said seminar was attended by large number of representatives from banking institutes and various aspects relating to investment, banking law, recovery law were discussed. Our Founder and Senior Advocate Mr. A.R. Gupta addressed a conference on “Legal Aspects of Property Transactions” at Ahmedabad Management Association, Ahmedabad on 26th November, 2011 catering to the various facets of property laws in India which was followed by interactive session. The laws as applicable to Indian Citizens, Non Resident Indians and Person of Indian origin were discussed at length. Our Firm Organised Open Discussion at our Law Office at Ahmedabad in the year 2012, wherein our founder Mr. A.R. Gupta, Senior Advocate provided guidance to the present audience focusing on various implications of Property Transactions, Family Laws, FEMA Laws and Investment in India by NRIs and PIOs and Foreign Nationals.  Mr. A. R. Gupta, Senior Advocate delivered a Lecture on “Legal Aspects of Property Transactions” at Ahmedabad Management Association, Ahmedabad on 28th September, 2013 precisely focusing on the important aspects of legal documentation of property transactions entered into by Indian Citizens, NRIs and PIOs. Mr. Gupta discussed at length the precautions to be taken in execution of various legal documents. A Meet was organized in July 2013 at our corporate office of NRIs and PIOs for discussion with regard to many difficulties faced by them for successfully handling litigation with regard to property matters, family disputes, investment and such other related issues. This was primarily and open discussion where various doubts were cleared. It was highly successful and satisfying discussion. One of the important question which many NRIs and PIOs wanted to know was whether they can purchase agriculture and or plantation land. It was clarified that there is total prohibition on NRIs, PIOs and Foreigners to purchase agriculture or plantation land.
